Our commercial litigation practice focuses on business torts and claims. For example, we have represented a large, publicly traded company in a case against a professional corporation that is alleged to have failed to adhere to professional standards with respect to the construction of a multi-million dollar telecommunications tower in the District of Columbia. The case raised complex questions of District of Columbia land use law that the court resolved in our client’s favor. In another commercial litigation case, Attorney Pawa successfully defended, on behalf of a small generic drug company, a trade secrets lawsuit by a major pharmaceutical company (Abbott Laboratories) that was seeking to prevent generic competition with its monopoly drug. With the trade secrets lawsuit now resolved in its favor, the generic company is working toward bringing its low cost drug to market. Pawa also succeeded in persuading the court in the generics case to declare invalid a non-compete agreement between Abbott Labs and one of its former employees.
Our real estate litigation practice involves zoning cases and property disputes. We focus in particular on the real estate litigation needs of the renewable energy industry, smartgrowth developers, and farms. We represent a non-profit group that has intervened in the Cape Wind cases and contributed to the favorable outcome in the state permitting process. We currently represent a farm in the suburban Boston area in zoning litigation addressing the Massachusetts right to farm law and in property litigation with neighbors. Our real estate litigation practice offers experience in adverse possession cases and in rights of first refusal under Massachusetts law.
